I don't know if you realize it, but they modify a game that isn't theirs. Mojang can take the code and claim it as theirs any day if they want to since you can't have copyright on stuff that originally isn't yours.

Besides, Notch has already said multiple times that mods kill his inspiration and he tries to stay away from that stuff. Adding something huge like an Aether mod to the vanilla game will never happen.
