I call bull on that. Whether or not he put them in his inventory, then threw them out; or just left them out would not make a difference to the victim.
Regulation should not matter on what one does with something after it is taken, it should be what was taken.

But it would make a difference. I'll go ahead and provide five examples of this to reach the highest possible level of condescending I can achieve.

1. If someone breaks someone else's vase, they did not steal the vase. They destroyed it.
2. If someone pulverizes someone else's farm animals, they did not steal the animals. They destroyed them.
3. If someone sets fire to someone's money, they did not steal the money. They destroyed it.
4. If someone demolishes someone's house, they did not steal the house. They destroyed it.
5. If someone upturns someone else's wheat farm, they did not steal the wheat. They destroyed it.
