So apparently the reason Bethesda is suing them is because there is some law in the USA that you need to enforce your copyright claim or lose it.
So Bethesda does not want to sue Mojang, they just don't want to lose their copyright.

If somebody names their thing the exact same thing that you named your thing, then they have broken the law and have to change the name of their thing.
